Your Will May Be the Last Document That Decides Where Your Money Goes

You spent time and money creating a well-drafted will. You named your children as heirs, spelled out your wishes for your home, your savings, and your personal property. You slept better knowing your family was protected.

But here is the reality that surprises countless families after a loved one dies: for most of the money you own, your will is irrelevant.

Retirement accounts, life insurance policies, bank accounts with a POD (payable-on-death) designation, investment accounts, and annuities all pass outside of your will — directly to whoever is named on the beneficiary designation form you filled out, possibly years or decades ago. If that form names your ex-spouse, a deceased parent, or a child who now has special needs and relies on government benefits, the money goes there — no matter what your will says.

Beneficiary designation errors are one of the most common — and most devastating — estate planning mistakes in America. The good news is they are also among the easiest to fix, once you know what to look for.

What Is a Beneficiary Designation?

A beneficiary designation is a legal instruction you provide directly to a financial institution — your bank, brokerage firm, insurance company, or retirement plan administrator — telling them who should receive the account or policy proceeds when you die.

These designations exist on:

IRAs (Traditional, Roth, SEP, SIMPLE)
401(k), 403(b), 457(b), and other employer-sponsored retirement plans
Life insurance policies
Annuities
Bank and credit union accounts with POD (Payable on Death) designations
Investment and brokerage accounts with TOD (Transfer on Death) designations
Health Savings Accounts (HSAs)
Certain pension plans and deferred compensation arrangements

Collectively, these assets often represent the majority of a person's wealth. For many middle-class American families, a 401(k), an IRA, and a life insurance policy account for well over half of everything they own.

And every single one of those assets passes by contract — not by will — directly to the named beneficiary.

Why Beneficiary Designations Override Your Will

This surprises many people: under both federal and state law, beneficiary designations are binding contracts between you and the financial institution. The account or policy is not part of your probate estate. A probate court has no authority over it. Your will has no authority over it.

When you die, the financial institution simply looks at whatever form is on file, confirms the beneficiary's identity, and transfers the funds. The process typically takes days or weeks — not months or years — and there is no court involvement at all.

That is actually a feature, not a bug. Beneficiary designations were designed to make asset transfers fast and simple, bypassing the delays and costs of probate. But simplicity becomes a problem when the form on file no longer reflects your actual wishes.

The Most Common Beneficiary Designation Mistakes

1. Outdated Beneficiaries After Divorce

You named your spouse as the beneficiary on your 401(k) in 2009. You divorced in 2018. You remarried in 2021. If you never updated that designation, your ex-spouse may still receive your retirement savings — even if your divorce decree said otherwise.

Courts have consistently held that beneficiary designations control, even when the parties believed a divorce settlement resolved the issue. Egelhoff v. Egelhoff, decided by the U.S. Supreme Court in 2001, confirmed that federal ERISA law preempts state divorce revocation statutes for employer-sponsored retirement plans. In other words, for 401(k)s and similar plans, your ex-spouse can legally collect — even after divorce — if you never changed the form.

IRAs are governed by state law and some states do automatically revoke beneficiary designations for ex-spouses at divorce, but relying on that is risky. The cleanest solution is always to update the form.

2. Naming a Minor Child Directly

Leaving retirement funds or life insurance directly to a minor child seems natural — but it creates a serious legal problem. Minors cannot legally receive large sums of money. When a minor is named as a direct beneficiary, a court must appoint a guardian of the property (sometimes called a conservator) to manage the funds until the child turns 18.

That means court supervision, annual accountings, restricted investment choices, and legal fees — often for years. At 18, the child receives the entire balance outright, with no strings attached, at an age most parents would not choose for a large inheritance.

The better approach: name a trust as beneficiary, with a trustee of your choosing to manage the funds until the child reaches an age you select — 25, 30, or in stages.

3. Naming a Beneficiary Who Relies on Government Benefits

If you leave an inheritance — through a will or a beneficiary designation — directly to a person with a disability who receives Supplemental Security Income (SSI) or Medicaid, that inheritance can disqualify them from benefits. These programs have strict asset limits, often as low as $2,000.

A direct inheritance or beneficiary payout can trigger a loss of benefits immediately. The solution is a special needs trust (also called a supplemental needs trust), which allows assets to be held for the benefit of a disabled person without counting against their eligibility for government programs.

You cannot simply change the beneficiary form to name the trust later in an emergency — the trust must be properly drafted and executed before the death of the account owner.

4. A Deceased Beneficiary With No Contingent Named

What happens when your named beneficiary predeceases you and you have no contingent (backup) beneficiary on file? The answer varies by institution and plan document, but it is rarely the outcome you would have chosen.

Many plans and insurance policies will default the proceeds to your estate, sending the money through probate — the very process beneficiary designations are designed to avoid. Probate can take months or years, costs money in legal and court fees, and becomes public record.

Others follow a per stirpes rule, passing to the deceased beneficiary's descendants. Others simply divide among any remaining primary beneficiaries.

The safest course: always name both primary and contingent beneficiaries, and keep them current.

5. Naming Your Estate as Beneficiary

Some people intentionally — or by default — name their estate as beneficiary of an IRA or retirement account. This is almost always a mistake.

When your estate is the beneficiary of an IRA, the account must be fully distributed within five years of your death (for those who died before required minimum distributions began), rather than over the life expectancy of an individual beneficiary. This dramatically accelerates the income tax bill on those distributions.

It also forces the account through probate, adding delay, cost, and public exposure.

6. Ignoring the Spouse's Rights in Retirement Plans

Under federal law (ERISA), if you are married and want to name someone other than your spouse as the primary beneficiary of your 401(k) or other employer-sponsored plan, your spouse must sign a written consent form. Without that consent, your spouse is entitled to the survivor benefit regardless of who you named.

This rule protects surviving spouses — but it also means that naming a child, sibling, or other person as beneficiary of a 401(k) without spousal consent may be legally ineffective.

The SECURE Act 2.0 and What It Means for Inherited IRAs

The rules governing inherited IRAs changed significantly with the SECURE Act of 2019 and the SECURE 2.0 Act of 2022. Understanding these rules matters when choosing beneficiaries.

Under current law, most non-spouse beneficiaries of an IRA must withdraw the entire balance within 10 years of the account owner's death. There is no longer a stretch IRA option for most people. This 10-year rule applies to adult children, siblings, friends, and most trusts.

Exceptions — called eligible designated beneficiaries — still receive more favorable treatment:

Surviving spouses
Minor children of the account owner (until they reach the age of majority)
Disabled or chronically ill individuals
Beneficiaries who are not more than 10 years younger than the decedent

Planning for the tax consequences of inherited IRAs — especially large ones — requires careful coordination between your beneficiary designations and your overall estate plan. A trust designed for IRA inheritance (often called an IRA trust or see-through trust) may be appropriate in some circumstances, but it must be structured precisely to qualify for favorable tax treatment.

How to Conduct a Beneficiary Designation Audit

The most important thing you can do today is take inventory. Here is a practical checklist:

Step 1: List Every Account and Policy

Pull together documentation for every retirement account (including old 401(k)s from former employers), every life insurance policy, every bank account, every brokerage account, and any annuities or pension plans. If you are unsure about old employer accounts, contact the Department of Labor's Abandoned Plan Database or reach out to former employers' HR departments.

Step 2: Request Beneficiary Designation Forms

Contact each institution and request a copy of the current beneficiary designation on file. Do not rely on memory. The form you signed 15 years ago when you opened a Roth IRA is what controls — not what you remember intending at the time.

Step 3: Review Each Designation Carefully

For each account, ask:

Is the named beneficiary still alive?
Is the named beneficiary still someone I want to receive this asset?
Does the named beneficiary have special needs or rely on government benefits?
Is the named beneficiary a minor?
Have I named a contingent (backup) beneficiary?
Does this designation coordinate with my will and trust?
If I have remarried or divorced, have I updated appropriately?

Step 4: Update and Confirm

Most institutions allow you to update beneficiary designations online or by submitting a new form. After submitting, always request written confirmation that the change was processed — not just that the form was received. Institutions do occasionally lose or fail to process forms, and you want a paper trail.

Step 5: Review After Every Major Life Event

Beneficiary designations should be reviewed after every significant life event: marriage, divorce, the birth or adoption of a child, the death of a named beneficiary, a change in a beneficiary's disability status or need for government benefits, and any significant change in the tax law or your financial situation.

Many estate planning attorneys recommend reviewing all designations at least every three to five years even without a triggering event.

Coordinating Beneficiary Designations With Your Overall Estate Plan

Beneficiary designations do not exist in isolation. They are a critical component of your estate plan, and they must be coordinated with your will, any trusts you have created, your powers of attorney, and your overall goals.

For example:

If you have created a revocable living trust to avoid probate, consider whether your bank and brokerage accounts have TOD/POD designations pointing to the trust — or whether you should retitle those accounts into the trust directly.
If you have a special needs trust for a disabled child, make sure all relevant retirement accounts and insurance policies name the trust as beneficiary (or name it as a contingent beneficiary) rather than naming the child directly.
If you want to leave retirement assets to charity, naming the charity directly as a beneficiary is often more tax-efficient than leaving those assets through your estate — the charity pays no income tax on the distribution.
If you want to equalize inheritances among children, be aware that a beneficiary designation is an all-or-nothing instruction to the financial institution — it cannot easily be combined with your will's fractional bequests without careful planning.

When to Work With an Elder Law or Estate Planning Attorney

For straightforward situations — a married couple with adult children, no special needs issues, and modest accounts — updating beneficiary designations may be something you can handle directly with your financial institutions.

But many situations call for professional guidance:

You have a large IRA and want to maximize the tax efficiency of distributions for heirs
A beneficiary has special needs or relies on SSI or Medicaid
You are in a blended family with children from prior relationships
You want to leave assets to a trust rather than individuals
You have a pension or complex employer retirement plan with survivor benefit elections
You are dealing with a recent divorce and are unsure whether prior designations were properly revoked
You want to include charitable giving in your estate plan

An experienced estate planning or elder law attorney can review your complete financial picture, coordinate your beneficiary designations with your other documents, and identify problems you may not have considered.
